01 Agreement to Terms

These Terms & Conditions constitute a legally binding agreement between you ("User") and divinoragifts ("we", "us", "our") governing your use of our website, mobile application, and gifting services. We reserve the right to update these terms at any time. Continued use of the platform constitutes acceptance of the updated terms.

02 Use of Platform

By using divinoragifts, you agree to:

• Be at least 18 years of age or have parental consent.
• Provide accurate, complete, and current registration information.
• Not use the platform for any unlawful purpose or in violation of any regulations.
• Not attempt to gain unauthorised access to any part of the platform.
• Not transmit harmful, abusive, or offensive content through our services.
• Maintain the security of your account credentials and notify us of any unauthorised use.

We reserve the right to suspend or terminate accounts that violate these terms.

03 Products & Pricing

• All products are subject to availability. We reserve the right to discontinue any product at any time.
• Prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise.
• We reserve the right to revise prices without prior notice. Your order price is locked at the time of checkout confirmation.
• Product images are representative. Minor variations may occur for handcrafted, floral, or perishable items.
• Custom/personalised products require additional processing time as stated on the product page.

04 Orders & Payment

• An order is confirmed only after successful payment and a confirmation email is sent.
• We accept UPI, credit/debit cards, net banking, and Cash on Delivery via Razorpay.
• divinoragifts is not responsible for delays caused by payment gateway or banking failures.
• In rare cases of stock unavailability, we will notify you and provide a full refund or replacement option.
• Coupon codes are subject to their individual terms and cannot be combined unless explicitly allowed.

05 Delivery

• Delivery is subject to availability at the recipient's pincode and the selected time slot.
• We endeavour to deliver on the selected date and time, but this cannot always be guaranteed due to circumstances beyond our control (traffic, weather, strikes, etc.).
• divinoragifts is not liable for delayed delivery caused by incorrect addresses or recipient unavailability.
• For midnight deliveries, the recipient must be available to receive the gift.
• Delivery charges, if applicable, will be displayed at checkout.

06 Cancellation & Refunds

• Orders may be cancelled within 2 hours of placement if the status is "Pending".
• Perishable items (flowers, cakes, food) cannot be cancelled once the order is confirmed.
• Approved refunds are processed within 3–7 business days to the original payment method.
• divinoragifts may cancel an order if unable to fulfil it due to stock or operational issues, with a full refund issued.
• Refer to our Return Policy for return eligibility and process.

07 Intellectual Property

All content on the divinoragifts platform — including logos, graphics, product photography, text, and code — is the exclusive intellectual property of divinoragifts or its licensors. You may not reproduce, distribute, or use any content for commercial purposes without our express written consent. You may share links to our product pages for personal, non-commercial purposes.

08 Limitation of Liability

To the maximum extent permitted by law, divinoragifts shall not be liable for:

• Indirect, incidental, or consequential damages arising from use of our services.
• Any loss or damage resulting from reliance on product descriptions or delivery timelines.
• Issues caused by third-party payment processors or delivery partners.
• Service interruptions due to maintenance, technical failures, or force majeure events.

Our maximum liability to any user shall not exceed the value of the order in question.

09 Governing Law & Disputes

These terms are governed by the laws of India. Any disputes arising from the use of divinoragifts shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. We encourage users to contact our support team first to resolve any concerns amicably before seeking legal remedy.
